      3. Round 2 winner will be announced October 1, 2020 at 10:00 pm ET.

    3. The Round 1 winner will be entered automatically in Round 2. It is possible that a song entered in Round 1 could win both Rounds and both prizes.

  2. Your song can be funny or serious but it must be an original composition. To avoid potential copyright disputes about what is and is not permitted under copyright law, it cannot be a parody of an existing work.

  3. To maximize its potential for “going viral” with exposure on television, YouTube and other social media platforms that display video, your entry must include a video track that is also an original composition. The video track can be as simple as a one-camera continuous shot of the song being performed by its musician(s). To avoid potential licensing disputes, the video track must not include stock photography or footage, even if you believe such content to be in the public domain or adequately licensed for use by Our Comeback. We must avoid potential copyright disputes about what is and is not permitted under copyright law.

  4. Your song should not support or oppose any particular candidate or party. It should call attention to the fact that few candidates pay much, if any, attention to the gender-based needs of men and boys.

  5. The Challenge is open to men and women who are U.S. Citizens or permanent legal residents of the United States and US territories.

  6. Judging Criteria:
    • Clearly and memorably expresses the significance of male gender issues.
    • Has potential to win airplay and “go viral” on audio and video platforms alike.

    • Has potential to induce/cajole/inspire/convince/persuade the presidential candidates and their campaign staffs to make positive public statements during the 2020 presidential campaign about the importance of attending to male gender issues for the good of the nation.

  7. Technical Requirements: Maximum file size: 150 MB
    • Acceptable formats: .avi .mov .mp4 .wmv
    • Lighting, focus and audio quality suitable for broadcast
    • Landscape (horizontal) orientation is preferable to portrait (vertical).
    • All else being equal, higher resolution is better than lower resolution.

    • Maximize length is five minutes.

  8. By making your submission, you grant Our Comeback and its successor non-profit organization a perpetual, world-wide, non-exclusive license to use it for advancing awareness and understanding of male gender issues, which may include using it in media products to be sold for non-profit fundraising. You warrant that you own the right and authority to grant such a license.

  9. You represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information by using the form at our-comeback.com/contact; (c) you are 13 years of age or older; and (d) your entry to the Challenge does not violate any applicable law or regulation. If you are under 18 years of age, however, you must have permission and clearance to enter the Challenge from your parent or legal guardian. Entry to the Challenge is void where prohibited.  Challenge winners are notified by email address. If a chosen winner does not respond to Our Comeback's notifications within seven (7) days, Our Comeback reserves the right to contact the runner-up for the receipt of the prize.

  10. By making your submission, you represent and warrant that your entry is an original work and that the content does not violate the privacy rights, publicity rights, copyrights, trademarks, contract rights or any other rights of any person or business.  You further agree to indemnify and hold Our Comeback harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of any breach of your representations and warranties set forth above and/or if any part of the entry causes Our Comeback to be liable to another.

  11. Winners will be notified by email and must sign and return an affidavit of eligibility/recording rights/publicity release within 14 days of notification date. The affidavit will state that winner's song and the accompanying video track are original works, that he/she holds all rights to the song and video, that he/she is a U.S. Citizen or permanent legal resident of the United States or a US territory. Failure to sign and return such affidavit within 14 days or provision of false/inaccurate information therein will result in immediate disqualification and an alternate winner will be selected. Affidavits for winners under 18 years of age at time of award must be countersigned by parent or legal guardian. Affidavits subject to verification by Our Comeback.

  12. Prize Payment will be made by December 1, 2020. This timeframe allows a reasonable opportunity for copyright and other possible disqualifying claims or other rule violations and circumventions to arise and be investigated. If arbitration is planned, pending or ongoing on December 1, 2020, payment of the prize money will be made after and in accordance with the results of arbitration.

  13. Prize will be awarded to the person who submitted the winning song; fair and equitable division of the prize among collaborators is the responsibility of the submitter. Our Comeback will be no party to disputes among musicians, crew and other contributors about who was promised what.

  14. Conflict Resolution: The parties shall attempt in good faith to resolve any dispute arising out of or relating to these Rules promptly by negotiation between persons who have authority to settle the controversy. Any party may give the other party written notice of any dispute not resolved in the normal course of business. If not resolved, any dispute, claim or controversy (i.e., contractual, tort, and/or statutory) arising out of or relating to these Rules or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of these Rules to arbitrate, shall be determined EXCLUSIVELY by arbitration in Baltimore, Maryland or Washington, DC before one arbitrator. The arbitration shall be administered by either the American Arbitration Association or JAMS. These Rules and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Maryland, exclusive of conflict or choice of law rules.
